Article 1 - Identification

 

MLS - MarieLaurenceStevigny is an online sales site managed and represented by MLStudio, registered under Belgian law as an SPRL.

In this document, "we", "us" or "our"... refers to MLS - MarieLaurenceStevigny. "You", "yours" or "yours"... refers to all users or visitors of the MLS - MarieLaurenceStevigny website(https://www.marielaurencestevigny.com/).

 

Article 2 - Scope of the agreement

 

1. These general terms and conditions apply to all our deliveries and services. These general terms and conditions exclude any other conditions on the part of the customer. Exceptions to these contractual stipulations are only accepted if we have confirmed them in writing and expressly specified them.

Only individual customers and end-user companies purchasing for purposes other than resale may place an order on the MLS - MarieLaurenceStevigny website. The resale or distribution of items purchased on the MLS - MarieLaurenceStevigny website is strictly prohibited. In addition, for each order you place on the MLS - MarieLaurenceStevigny website, you will be asked to accept the terms and conditions in effect at the time of the order. In view of the commercial policy described above, we reserve the right not to respond to orders placed by persons other than the final purchaser, or to orders that do not comply with our commercial policy as defined herein.

These terms and conditions may be modified at any time, in particular to comply with regulatory changes. The new terms and conditions apply as soon as they are posted on the MLS - MarieLaurenceStevigny website.

 

2. To place an order, you must be at least 18 years of age. If you are under 18, please consult your parent or guardian before placing an order.

 

Article 3 - Offers and contracts

 

1. If an offer is valid for a limited period or is subject to conditions, this is always expressly stated in the offer.

 

2. Our offer contains a complete and accurate description of the products offered. The description is sufficiently detailed to enable you to evaluate the offer correctly. The usual minimal technical differences in quality, color, width, weight, manufacture... cannot be considered as defects or non-conformities.

 

3. Your order will be complete and the contract will be issued as soon as we have confirmed your order by e-mail AND as soon as we have received approval of your transaction from your credit or debit card issuer. We are not responsible for delays in delivery and/or non-delivery of your order if such delays are due to the refusal of your payment by your card issuer. No order will be accepted or processed without valid payment in the name of the registered cardholder.

Before placing your order, you are asked to accept the general terms and conditions of sale in force at the time of ordering. You cannot order from our site if you do not accept these terms and conditions.

 

Article 4 - Right of withdrawal

 

1. For any purchase of goods or services, you have 14 calendar days from delivery to withdraw from the contract. During this period, you may return your order without penalty and without giving any reason (you are responsible for the cost of returning the goods). Within 14 days of returning your order, we will refund the full purchase price, using the same method of payment used for the original transaction.

 

2. You are therefore responsible for the cost of returning the goods. We will indicate the exact cost of the return or give an estimate if it is impossible to predict the exact cost.

 

3. We may defer refund until the goods have been recovered or until you have provided proof of shipment of the goods, whichever comes first.

 

4. During the withdrawal period, we advise you to handle the goods and packaging with care, and not to unpack or use them as much as necessary in order to assess whether you wish to keep the goods. If you make use of your right of withdrawal, we ask you to return the goods with all accessories supplied and in their original condition and packaging, in accordance with our instructions below.

 

5. You can return your package by mail or courier, and you must keep the tracking number until the transaction is completed.

 

6. To execute your right of withdrawal during the period, please inform us of the return of the complete or incomplete order using the form on this page https://www.marielaurencestevigny.com/returns, using the document inside your delivered order or by sending an email to this address info@marielaurencestevigny.com.

Article 5 - Prices

 

1. During the period of validity mentioned in the offer, the prices of the goods and/or services offered will not be increased, with the exception of price changes resulting from changes in VAT rates.

 

2. Our prices include all taxes and services. So there will never be any surprises for you. However, we may decide to charge you a delivery fee. In this case, we will inform you before confirming your order.

 

Article 6 - Payment

 

1. Payment is limited to the payment methods offered on our website. Credit card secured by Stripe.

 

2. To ensure secure online payment and the safety of your personal data, transaction data is encrypted using SSL technology sent over the Internet. To pay with SSL, you don't need any special software. You can recognize a secure SSL connection by the "lock" in your browser's status bar.

 

Article 7 - Conformity and warranty

 

1. We warrant that our products conform to your order and meet the normal expectations you may have based on the product specifications. We also guarantee that our products comply with all laws in force at the time of your order.

 

2. In addition, with regard to the delivery of goods, you benefit from the minimum warranty period of two years in the event of non-compliance with the description of consumer goods.

 

You have the right to request that the goods be repaired or replaced free of charge (at the consumer's option, but as far as is possible and reasonable). If repair or replacement is disproportionate or impossible, or cannot be carried out within a reasonable time, you have the right to demand a price reduction or refund.

 

If the defect is minor, you cannot demand a refund.

 

If the defect is discovered within the first six months, it is presumed to have existed since delivery. The seller must prove the contrary if he disagrees. If the defect is discovered more than six months after delivery, the consumer must prove that the non-conformity existed at the time of delivery.

 

To maintain good quality and keep your favorite Pocket in good condition, we provide after-sales service from one month after the date of purchase: for all products to be returned to MLS, a "repair" fee will be charged at €35 plus VAT to be paid in advance. This fee covers just the cost of shipping to our Spanish workshops and a small basic repair; if your repair requires more expense from our workshops, we'll provide you with a quote for your approval.

 

Article 8 - Delivery and performance

 

1. Deliveries are made to the delivery address indicated in your order.

 

2. Items are dispatched once your order has been confirmed. The usual delivery time is estimated at 2 days from your order. This delay of 2 days is given as an indication. We cannot be held responsible for any further delay. If you have any queries about the status of your order, please do not hesitate to contact us at info@marielaurencestevigny.com. We will do our utmost to satisfy you as quickly as possible.

 

3. Deliveries are made every day before noon.

 

4. Delivery charges vary according to destination.

-Belgium: €7.

-Germany, France (except Dom-Tom), Grand Duchy of Luxembourg, Netherlands: €18 

-Austria, Bulgaria, Cyprus, Czech Republic, Denmark, Estonia, Finland, Greece, Hungary, Ireland, Italy, Latvia, Lithuania, Madeira, Malta, Man, Monaco, Poland, Portugal, Romania, Slovakia, Slovenia, Spain, Sweden, USA and Croatia: €30.00.

5. If we are unable to ship on time, we will always notify you in advance. If we do not inform you in time, you have the right to cancel your order free of charge. In this case, we will reimburse you within 30 days of cancellation.

 

6. Shipment of your order is always at our risk, so you never have to worry about lost goods. Goods returned to us within 14 days of purchase because you do not wish to keep them are always at your own risk.

 

7. If the goods we have delivered have been damaged in transit, do not correspond to the items on the delivery note or do not correspond to the items you ordered, you must inform us as soon as possible, and at the latest within 3 days, and you must then return the items in question within 14 days of receipt.

 

Article 9 - Force majeure

 

1. In the event of force majeure, we are not obliged to fulfil our obligations to the other party. In this case, we have the right to suspend our obligations for the duration of the force majeure or to cancel your order definitively.

 

2. Force majeure means any circumstance beyond our control by which the performance of our obligations to you is totally or partially impossible. These circumstances include: strikes, lock-outs, labor disputes, fire, technical incidents, power cuts, disruptions to networks, telecommunication lines or communication systems used and/or the unavailability of our website, failure to deliver or late delivery by suppliers or other third parties and lack of authorization for receipt by the authorities...

 

Article 10 - Intellectual property

 

1. The Buyer expressly acknowledges that all intellectual property rights relating to the information provided, communications or other statements concerning the Products and/or the Website belong to MLS - MarieLaurenceStevigny, its subcontractors or other rights holders.

 

2. The Buyer is prohibited from using and/or modifying the intellectual property rights as described in this article, e.g. reproducing them without the prior express written consent of MLS - MarieLaurenceStevigny, its subcontractors or other rights holders.

 

Article 11 - Complaints procedure

 

1. Of course, we always hope that all our customers are 100% satisfied. Should you still have any complaints, please do not hesitate to contact us at info@marielaurencestevigny.com. We promise to deal with your complaint within 7 days.

 

2. Belgian law is exclusively applicable to all contracts with our customers, regardless of their place of residence. All disputes arising from or in connection with MLS - MarieLaurenceStevigny offers are subject to the exclusive jurisdiction of the Belgian courts. If, for reasons of international law, another law is applicable, it will be interpreted in the first instance in accordance with the Belgian law on market practices and consumer protection.

 

In case of dispute, the English version of these terms and conditions shall prevail.
